Why is an employment contract necessary?
An employment contract is an agreement between two parties. It contains regulations governing the employment relationship as well as the rights and obligations of both parties. It is drafted to provide equal protection for both employees and employers.
What types of employment contracts are there?
Switzerland’s legal system defines various types of employment contracts. These include, among others:
- Individual employment contract (EAV)
- Collective employment contract (GAV)
- Standard employment contract (NAV)
For individual employment contracts, there are also special forms such as:
- Apprenticeship contracts
- Commercial traveler contracts
- Home work contracts
Legal provisions governing employment contracts are set out in the Swiss Code of Obligations (OR), starting from Art. 319 OR.
How do you terminate correctly?
Both employees and employers have the right to terminate an employment relationship.
In the case of a fixed-term contract, the employment relationship usually ends automatically without notice.
In the case of an open-ended contract, termination must be given. The employment contract usually specifies whether termination must be in writing. If not specified, verbal termination is sufficient.
A termination is only valid once it has been received by the other party. In Switzerland, there is no obligation to state a reason for termination unless the other party explicitly requests one.
For a termination to be valid, the notice period specified in the employment contract must be observed. If no notice period is defined, the statutory Swiss notice periods under the Code of Obligations apply.
If an employee is on sick leave, has suffered an accident, is performing military or civil service, or is pregnant, a temporary protection against termination applies.
Which social insurance contributions must be paid?
From the age of 18 until the end of gainful employment, contributions to social insurance must be paid.
Contributions to Old Age and Survivors’ Insurance (AHV), Disability Insurance (IV), and Loss of Earnings Compensation (EO) are paid equally by employer and employee. Unemployment insurance (ALV) is also shared equally between employer and employee.
In addition:
- Occupational accident insurance (BUV) is paid by the employer
- Non-occupational accident insurance (NBUV) is paid by the employee, or optionally by the employer
Daily sickness allowance insurance (KTG) can also be taken out for employees. This insurance covers salary payments in the event of illness. It is important to note that KTG insurance is voluntary and not mandatory.
For occupational benefits (BVG), employees must be registered if they exceed the annual entry threshold (minimum salary).
What is employees’ vacation entitlement?
Under Art. 329a OR, employees are entitled to:
At least 5 weeks of vacation per year until the age of 20
At least 4 weeks of vacation per year thereafter
Who has to pay withholding tax?
All foreign employees living in Switzerland without a settlement permit (permit C) are subject to withholding tax. Persons living abroad who earn income in Switzerland are also subject to withholding tax.
The tax amount is deducted directly from the employee’s salary by the employer and transferred to the tax authority.
